John Pennington2While the folks there at Remax are friendly enough, it is clear they are not going to miss a single dollar. My experience with them demonstrated this as I was charged $2400 just for creating a contract for me. I had already sold the home and arrived at terms with the buyer, but they still insisted on a 3% commission just for the contract. I also had to wait 3 weeks longer than I wanted, but my pleas to move the closing up fell on deaf ears. Additionally, they have their special arrangements with other local service entities which I found a bit off-putting, and clarification had to be made on my part to prevent being co-opted into their services. Lastly, I was not given the title to my home even after the discussion made clear, that I would hold the title in my name until the place was 100% payed off. So a full week after the late closing, I'm still picking up the mess caused by this organization. But they have their money, so I'll just go soak my head, and you can too if you go with Remax/Thermopolis.
Response from the ownerDear John, Thank you. Yes, we are friendly and yes, we do a fabulous professional job not just finding the buyer but getting the sale closed. I personally explained the listing in depth to you on March 10, 2017. You were told that I would do the transaction with one buyer at a reduced commission, you agreed to that and seemed to understand that there is a lot more to getting a property sold than just finding the buyer. The offer was not written until April 17 because you were in the process of clearing the title and your buyer did not come to see us until that day. Yes, we suggested a title company that could help you with that, however there is no special arrangements with a specific title company and indeed most title companies would have made you deal with the person who needed to sign off on the title directly. That particular title company went above and beyond what is their responsibility to help us and to help you. At the time of listing you signed a seller’s cost estimate which reflected the $2450 commission, so this was not news to you after it went under contract John. You were given a huge reduction, $3200 to be specific. The contract that we wrote on your behalf John stated the closing was going to be May 5, 2017. Because we have been doing this for 30 years and we have handled thousands of transactions and hundreds of owner finance transactions we knew at least that amount of time was needed to hire an attorney to get your note and mortgage written, clear the title on your property, get the title to your mobile home, etc. Indeed, the note and mortgage which was written by an attorney was received by us May 1, 2017 with corrections made by May 3 to facilitate in mailing papers for your signature on May 3, 2017 so that the closing would occur on May 5, 2017. In response to the title to the mobile home, RE/MAX nor the title company had any control over the transfer of title. We counseled that you keep the title in your name until the note was paid off in full, and you chose to sign it over at closing. We advise, you decide. We did not facilitate the transfer of sale, because it is personal property, you personally signed the title over to the buyers at closing. You have my personal cell phone number John and if there were any concerns on your part you could have surely picked up the phone and as the co-owner/Associate Broker I would have been most happy to help. When you listed the property with me you stated that this transaction was not something that you were equipped to handle. My hope is that you are now fully cognizant of what is necessary to sell a property owner finance in a way that protects you as seller and buyer. Again, please pick up the phone and call if you have any addition concerns or feedback.
